The precautionary principle is one of the great puzzles of international law. It is designed to promote environmental protection by excluding scientific uncertainty as a justification for delaying action in the face of potential threats to the environment. Its influence in the area of trade law is particularly interesting. The principle is intended to bridge the regulatory gap between economic development, social justice and environmental protection. The present article explains how the precautionary principle plays out in WTO law.
Il principio di precauzione nel diritto dell'Organizzazione Mondiale del Commercio (WTO) ha assunto una valenza ed una portata più limitata rispetto all'interpretazione ed all'applicazione che il principio riceve in altri ambiti del diritto internazionale. In questo articolo viene illustrata l'evoluzione del principio nell'ambito del WTO e vengono spiegate le ragioni per le quali questo si distingue dall'accezione con la quale viene riconosciuto nel diritto internazionale.
