The article analyses the preliminary judgement delivered on 26 June 2025 by the African Court on Human and Peoples’ Rights in the first inter- State case brought before it pursuant to Article 3 of the Protocol to the African Charter on Human and Peoples’ Rights: Democratic Republic of Congo v.
