The EU Court of Justice reiterated that the Hungarian legal framework on Asylum and Migration does not comply with EU Law: Hungary has failed to fulfil its obligations under EU law in the area of procedures for granting international protection and returning illegally staying third-country nationals. By analyzing the judicial decision, it is argued that the distinction between "making an application" and "lodging an application" in Article 6 of Directive 2013/32 has relevant legal implications. The Court recalled that the making of an application for international protection (prior to its registration, lodging and examination) is an essential step in the procedure for granting international protection and that Member States cannot hinder or delay it.
