The purpose of this paper is to discuss some of the provisions of Draft Articles on diplomatic protection adopted on first reading in 2004 by the International Law Commission. Draft Article 8 is entirely devoted to the particular position of stateless persons and refugees. The drafting of the provisions of Article 8 proved to be extremely difficult given the highly controversial nature of the question whether diplomatic protection can be exercised in respect of non-nationals of the claimant State.
