The author analyzes the ruling of the Council of State on the commerce regulation of the municipality of Rome with reference to the minimum proximity between businesses alike. The decision is interesting because it relates to the rules of the competition with the strict discipline within the retail sector and carries out an in-depth reflection on the relationship between the national legislation and local expertise. The author concludes that the obligations of competition should take precedence over local restrictions except for narrow exonerations
L'autore analizza la sentenza del consiglio di stato relativa alla disciplina del commercio del comune di Roma con riferimento ai minimi di vicinanza tra esercizi commerciali simili. La decisione è interessante perché mette in relazione le regole della concorrenza con la disciplina restrittiva in ambito del commercio al dettaglio e svolge un'approfondita riflessione sul rapporto tra disciplina nazionale e competenze locali. L'autore trae la conclusione che gli obblighi di concorrenza debbano prevalere sulle discipline locali restrittive salvo deroghe che siano ammesse dal livello nazionale.
