La presunzione relativa di adeguatezza fra oneri probatori e obblighi motivazionali

This research addresses the topic of presumption in terms of pre-trial precautionary measures investigating on the rebuttable presumption of the adequacy of custody, affirmed by numerous judgments as unconstitutional of art. 275, para. 3, Code of Criminal Procedure. Exspecially the Author analayzes the issues of evidentiary burden-sharing, so as to determine a possible distribution of such and the obligation of the judge to state the reasons supporting the decision, in order to identify the framework of the justification of a precautionary measure

Il lavoro affronta il tema delle presunzioni nella materia cautelare proponendosi di indagare sul funzionamento della presunzione relativa di adeguatezza della custodia in carcere affermatasi con le numerose declaratorie d’illegittimità costituzionale dell’art. 275, comma 3, c.p.p. In particolare l’Autore analizza le problematiche connesse alla ripartizione degli oneri probatori, sì da delineare una possibile distribuzione degli stessi, nonché quelle relative all’obbligo di motivare del giudice, al fine di individuare la struttura che la motivazione del provvedimento cautelare
