Illegittimità conseguenziale delle leggi e discrezionalità. Commento alla sentenza n. 251 del 2016 della Corte costituzionale

The paper reconstructs judgment n. 251/2016, by which the Constitutional Court declared the unlawfulness of certain provisions of l. n. 124 of 7 August 2015. With this act Parliament had delegated the Government to reorganize public administrations. In the judgment the Court confines the ruling only to the enabling act, without prejudice to the resulting legislative decree, excluding the application of the institute of the consequential unlawfulness of the laws referred to in art. 27, paragraph 2, of l. n. 87/1953. The contribution, therefore, reconstructs the institute of consequential unlawfulness in order to assess the correctness of the Constitutional Court’s decision.
