Prospettive di riforma della disciplina europea delle restrizioni operative per il contenimento del rumore negli aeroporti

The essay analyzes the Proposal for a Regulation of the European Parliament and of the Council on the establishment of rules and procedures with regard to the introduction of noise-related operating restrictions at Union airports within a Balanced Approach and repealing Directive 2002/30/EC of the European Parliament and Council [COM (2011) 828 final]. It illustrates the regulatory evolution in the fight against the airborne noise and explains the reasons for the reform of Directive 2002/30/EC, focusing, also, on the disciplinary innovations of the Proposal and on its structural limits.

Lo studio analizza la proposta di regolamento del Parlamento europeo e del Consiglio che istituisce norme e procedure per l’introduzione di restrizioni operative ai fini del contenimento del rumore negli aeroporti dell’Unione, nell’ambito di un approccio equilibrato, e abroga la direttiva 2002/30/CE del Parlamento europeo e del Consiglio [COM (2011) 828 def.] Dopo aver tratteggiato le linee evolutive della lotta al rumore aeronautico e le ragioni sottese alla riforma della direttiva 2002/30/CE, lo scritto si sofferma sulle novità disciplinari introdotte dalla Proposta, evidenziandone, anche, i limiti strutturali.
