The works of Salgari, because of their literary genre connotation, offer to the legal scholar an opportunity to meditate about the limits of the national unification processes and of the edification of a civic identity, as well as on the ethical and cultural deficits of liberal leaders, and on how these shortcomings are reflected at institutional level. In this perspective, the novels of the “Malaysia series” raise several questions about the Italian colonial experience, still insufficiently considered by legal scholars despite the density of its implications for the “metropolitan” constitutional vicissitudes. At the same time, however, these novels reveal an interesting anachronistic side if read through the prism of children’s literature. Sandokan’s world, with its Malaysian pirates, has nothing to do with mainstream pedagogy in the late nineteenth century and in fascist Italy. It keeps reminding young readers that baddies are bullies and fanatics, and that a friend or a mate may well be a person coming from a faraway land.
Le opere di Salgari, anche in ragione della loro connotazione di genere, offrono al giurista un’occasione per riflettere sui limiti dei processi di unificazione nazionale e di costruzione di un’identità civica, sulle carenze culturali ed etiche delle dirigenze liberali e sui loro riflessi istituzionali. In questa chiave, i romanzi dei “cicli malesi” riportano all’attenzione la vicenda coloniale italiana, ancora poco considerata dai giuristi nonostante la densità delle sue implicazioni per le vicende costituzionali “metropolitane”. Allo stesso tempo, tuttavia, quegli stessi romanzi rivelano una interessante inattualità se letti nel prisma della letteratura per ragazzi. Distante dalla pedagogia ufficiale dell’Italia umbertina e fascista, il mondo di Sandokan e della pirateria malese continua a ricordare ai giovani lettori che i cattivi sono i prepotenti e i fanatici, e che l’amico o la compagna possono venire da paesi lontani.
