Una missione impossibile? Il Parlamento europeo e l'obiettivo di una Costituzione europea (1952-2007)

The article analyzes the efforts of the European Parliament to promote the creation of a European Constitution. The first attempt was that of the Ad Hoc Assembly, which approved on 10 March 1953 the Draft Treaty embodying the Statute of the European Community. This Draft was abandoned in consequence of the rejection of the EDC Treaty by the French Parliament in 1954. The second one was the Draft Treaty on the European Union adopted by the European Parliament in 1984, whose main author was the Italian federalist Altiero Spinelli. It was taken into account in a quite limited way by the reform of the Community institutions which occurred in 1986. Then, ten years later, the European Parliament discussed a draft of European Constitution whose rapporteur was Belgium’s Fernand Herman. Finally, the European Parliament was one of the main promoter of the elaboration of a constitutional text by the European Convention presided over by Giscard d’Estaing in the years 2002-2003. However, The French and the Dutch referendums in 2005 put an end also to this effort. The article examines the results of this constitutional activity and the obstacles it encountered.

L’articolo analizza i tentativi del Parlamento europeo di promuovere la creazione di una Costituzione europea. Il primo tentativo fu quello dell’Assemblea ad Hoc, che approvò il 10 marzo 1953 il progetto di Trattato che stabiliva lo Statuto della Comunità europea. Questo progetto fu abbandonato a causa della bocciatura del Trattato CED da parte del Parlamento francese nel 1954. Il secondo fu il progetto di Trattato sull’Unione europea adottato dal Parlamento europeo nel 1984, il cui principale autore fu Altiero Spinelli. Fu preso in considerazione solo molto parzialmente quando le istituzioni comunitarie furono riformate nel 1986. Successivamente, dieci anni dopo, il Parlamento europeo discusse il progetto di Costituzione europea il cui relatore fu il belga Fernand Herman. Infine, il Parlamento europeo fu uno dei principali promotori dell’elaborazione di un testo costituzionale ad opera della Convenzione europea presieduta da Giscard d’Estaing negli anni 2002-2003. Tuttavia i referendum in Francia e in Olanda del 2005 posero fine a questo tentativo. L’articolo esamina i risultati di questa attività costituzionale e gli ostacoli incontrati.
