A propos de ‘Peaceful Change’ de Vladimiro Degan (1981/1982-II) : l’évolution de la transformation pacifique du droit international

Rarely treated by international legal scholars, the issue of "peaceful change" has been discussed in vol XVI of this Journal. The author, Vladimiro Degan, dealt with the capacity of the international legal order to adapt to the transformations of international relations. The present contribution analyses three main factors characterising the evolution of present international community that put into a new light the analysis of Vladimiro Degan. These are the role of international organizations, the role of international courts and tribunals, and the new approach to the adaptation of existing international rules.

Rarement abordée par les internationalistes, la question des « changements pacifiques » du droit a fait l’objet d’une analyse détaillée dans le seizième volume de cette Revue (1). Son auteur, Vladimiro Degan, se penche sur la capacité de l’ordre juridique international de s’adapter aux transformations des relations internationales. L'auteur analyse trois facteurs principaux qui caractérisent l’évolution récente de la communauté internationale et qui permettent de jeter un regard nouveau sur l’analyse de Vladimiro Degan: le rôle des organisations internationales, le rôle du juge international, et la nouvelle approche concernant l'"adaptation" des règles internationales.
