This article deals with basic income in a constitutional law perspective. In the first part, the main arguments commonly put forward in scientific legal literature in order to justify the constitutional compatibility of basic income are identified and subjected to criticism. In the second part, the legislative changes introduced by Law n. 183/2014 and the implementing decrees concerning the activation of individuals without work (in particular, Legislative Decree. n. 150/2015), as well as the different proposals in this field presented by the parliamentary minorities, are also treated in a critical perspective. The conclusion of the article is that the Italian Constitution, laying the foundation of the “Democratic Republic” on labour, considers such constitutional value more relevant than income. This issue leads to significant consequences for the measures aimed at ensuring a free and dignified existence that the ordinary legislator is allowed to adopt.

Abstract
