The paper deals with the composition of the "new" Senate provided in the constitutional reform. If the constitutional reform went into effect, the Parliament would set, with a bicameral ordinary law, the rules for the second chamber election. The essay sets out the constitutional parameters concerning the electoral system introduced by the reform of Article 57 of the Constitution. The article is about the characteristics this new electoral law should have and the limits it should respect. In the end, the aim is to imagine how the electoral law for the Senate election would be. The many parameters and the interaction between Senate electoral law and Regions electoral laws lead to the conclusion that the discretion of the Parliament will be very limited.
L’articolo si occupa di analizzare quella che sarà la composizione del Senato previsto dalla riforma costituzionale. Se la riforma costituzionale dovesse entrare in vigore a seguito del referendum sarà infatti il Parlamento a dover stabilire, attraverso una legge ordinaria bicamerale, quali saranno le regole elettorali per l’elezione dei senatori. L’articolo descrive e analizza innanzitutto quali sono i parametri costituzionali, introdotti dalla riforma dell’articolo 57 della Costituzione, relativi al sistema elettorale del Senato. ll saggio descrive quindi le caratteristiche che questa nuova legge elettorale dovrebbe avere ed i limiti che essa dovrebbe rispettare. Da queste premesse si prova, infine, ad immaginare quale potrà essere la legge elettorale per l’elezione dei senatori, che stante i numerosi parametri e la circostanza che la legge elettorale dovrà integrarsi con le leggi elettorali regionali, porta alla conclusione che sarà limitato lo spazio di discrezionalità del legislatore ordinario
