In the carriage by bus, the passenger who complains about a violation of his rights carried out by the carrier has at his disposal several means of protection. They do not necessarily overlap and are as follows: the use of ordinary justice; the ADR (Aternative Dispute Resolution) proceedings; the administrative complaint for the initiation of the sanctionatory proceedings towards the carrier. To each of these solutions correspond three different passenger ‘s expectations. In fact, in the first case, the outcome will be an adjudicative content, depending on the distribution of the right and wrong by the judge; in the second case, the solution of the dispute will have an extremely open content and will be not compel within the limits imposed by the application of the demand principle, whether it will be the result of a negotiation between the parties or facilitated by the intervention of a mediator. In the third case, the outcome of the proceedings may be represented by the imposition of penalties, mostly fines, imposed by the administrative Authority designated under EU regulation 181/2011
Nel trasporto di persone a mezzo bus, il passeggero, alla luce del contesto attuale, dispone di diversi strumenti di riconoscimento dei propri diritti che possono essere collocati in tre piani diversi: a) il piano giurisdizionale ordinario; b) il piano collaborativo/partecipativo; c) il piano amministrativo. A seconda che il passeggero decida di intraprendere uno dei percorsi sopra indicati, potrà vantare aspettative diverse, e quindi non necessariamente coincidenti, rispetto agli obiettivi da conseguire.
