Wrongful life is a greatly debated topic in Italy. The Italian Supreme Court judgment n. 16754 of the 2nd October 2012 granted, not only to the parents but also to the child, compensation for being born disabled because the doctor had failed to diagnose genetic malformations. This was the first Sentence in Italy, which legitimated a wrongful life lawsuit. A situation of uncertainty as whether or not the damages should be paid arose. The joint sections of the Italian Supreme Court finally solved this issue in a recent case in 2015.
