The author examines the principle non ultra petita as applied by the International Court of Justice in the merits decisions of the case concerning Certain activities carried out by Nicaragua in the border area. The analysis is meant to shed light on the limits that may surround the duty of the Court to rule on the parties submissions when the procedural dimension of the principle non ultra petita is taken into account and when it should be balanced with procedural economy.
L'auteur examine le respect de la part de la Cour du principe non ultra petita par l’arrêt concernant Certaines activités menées par le Nicaragua dans la région frontalière. L'analyse permet de comprendre quels pourraient être les limites de ce devoir de la Cour tout particulièrement lorsque le principe non ultra petita est conçu dans sa dimension procédurale et doit être mis en balance avec des exigences d’économie judiciaire.
