Art. 20 of the 1929 Warsaw Convention on the international air transport says that the carrier can avoid his liability «s’il prouve que lui et ses préposés ont pris toutes les mesures nécessaires pour éviter le dommage ou qu’il leur était impossible de les prendre». This expression has been adopted by Italian civil code in some cases of tort liability e in the liability of the road carrier in the transport of passengers. The 1999 Montreal Convention has kept the expression in the delay liability. This paper studies in depth this expression, pointing out the carrier relevant conducts, in comparison with the different expression contained in art. 1218 of the Italian civil code that refers to the «not imputable cause».

Abstract
1218 of the Italian civil code that refers to the «not imputable cause».I documenti in IRIS sono protetti da copyright e tutti i diritti sono riservati, salvo diversa indicazione.
