The duty of care of passengers is examined first as an accessory and autonomous obligation as regards the transfer obligation. Secondly the foundation of its essentiality in the context of the contract of transport is considered. Then the standard and the contents of the obligation are examined in the rules relating to maritime and air transports. In conclusion, the differences existing in the regulation of maritime and air transport do not look completely justified
