The corrective action, set by the 611th paragraph of the L. 27 December 2013 n. 147 and by the Sentence n. 98 of the Constitutional Court pronounced on the 16th April 2014, on the regulation of the article 17-bis of the D.lgs. 546/1992, did not cast light on the “grey area” of the controversial figure of the “mediation-claim”, despite the fact this method is been made more congruent with the Constitutional Chart’s principals. Indeed, the “mediation-claim” still presents an high level of criticality and, probably, a new intervention, by the Legislator or the Constitutional Court, will be needed.
I correttivi operati all’art. 17-bis del D.lgs. 546/1992 rispettivamente con il comma 611 della Legge 27 dicembre 2013, n. 147, e con la sentenza 16 aprile 2014 n. 98 della Consulta, pur avendo reso maggiormente conforme al dettato Costituzionale il c.d. reclamo-mediazione, non hanno gettato definitiva luce su tutte le “zone d'ombra” di un istituto assai controverso. Lo strumento deflattivo continua, infatti, a presentare dei rilevanti profili di criticità in ordine ai quali, con ogni probabilità, si renderà necessario un nuovo intervento del Legislatore o della Corte Costituzionale
