The article analyzes the Italian case law in relation to the political crimes between the liberal state and fascism. The author highlights the elements of continuity between the two different periods in the repression of the radical political dissent (specially, socialism and anarchism), making use of the comparison with the jurisprudence of the US Supreme Court in the same period. At least, the article concludes with a reflection on the relationship between the judiciary and fascism.
