This paper analyses the principle established by the decision n. 2755/2011 of the Consiglio di Stato, concerning the power of the Court to limit the effects of the annulment of an act found to be void, and its application by the Administrative Courts’ case law. This work aims to demonstrate that such a principle shall be considered in a different light in order to comply with the rules governing the procedure before the Administrative Courts.
