Azione di adempimento, disponibilità della situazione giuridica e onere della prova

This paper represents the Author’s intervention at the 10th annual Conference in the honour of Eugenio Cannada Bartoli. It consists in an overview of the relationship between the azione di adempimento (mandatory order), introduced by the Codice del Processo Amministrativo (Administrative Procedural Code), and the procedure before the Administrative Courts. In the Author’s opinion, the above mentioned remedy, by which the claimant is entitled to obtain an administrative decision, requires a particular kind of judicial review; therefore the procedure before the Court pursuing the azione di adempimento (mandatory order) should differ from the standard procedure, based on the azione di annullamento (quashing order).
