In 18th century France the model of the Mixed Constitution included the recognition of parties, considered as necessary for the creation of a democratic public space. As a consequence, this constitutional model separated itself from the merely juridical formulation proposed by Montesquieu, allowing itself a long and productive political future way into the 19th century.
