Problems in implementing Directive 2009/12/EC in the Italian Legal System

The paper focuses on the notion of «airport charge», contained in the Law Decree No. 1 of 2012 (article 72.1), which has implemented the provisions of the Directive 2009/12/EC in the Italian legal system. It highlights the broader scope of application of the aforementioned notion, than that proposed by the European measure (article 4.2), as it also refers to the fees for the use of both centralized infrastructure and goods of common and exclusive use. In this regard, the assay identifies what centralized infrastructure are and also analyzes the methods for determining the charges for their use, both in the Law Decree No. 1 of 2012 that in the Legislative Decree No. 18 of 1999, which has enacted Directive 96/67/EC on ground-handling services in the European Union airports.
