This paper is intended to be a plea for a real and fearless application within the Courts’ case law of the presumption of innoc ence , a principle that would not be incidental to the criminal proceedings once it actually guarantees that the act of justice is based on reliable evidence destined to serve for the protection of human’s rights and freedoms and more so in dubio pro reo.
