La riservatezza del processo arbitrale in Italia

The works consists in an opinion of the author , as an expert of Italian law, on the issues below. The questions to be answered by reference to Italian law are: 1.are Italian arbitration proceedings confidential in nature? 2.if the answer to 1 above is yes, does confidentiality apply to the entire arbitration process, including documents (for example the arbitration statements of case, witness statements, questions to witnesses) and the hearings or does it apply to the hearings only? 3.if the answer to 2 above is that confidentiality applies to the entire arbitration process, can a party to arbitration waive confidentiality in one part of the proceedings (e.g. the documents), but retain it in relation to another part (e.g. the hearings)? The issues at hand are of great systematic interest and altogether they reflect the values of legal systems. Thus they deserve an extensive research.
