The Second Amendment to the US Constitution, entitled "Right to Bear Arms," reads: "A well-regulated Militia, being Necessary to the security of a free State, the right of the people to keep and bear Arms, Shall not be infringed. "That enshrined is an unusual, particularly controversial and ethically and legally complex right, with implications in the constitutional evolution and unexpected political repercussions. The second amendment is still the object of a very lively debate that also involves the Supreme Court jurisprudence and of which the author traces the evolution up to the latest developments.
Il II Emendamento alla Costituzione degli Stati Uniti, rubricato “Right to Bear Arms”, recita: “A well-regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed”. Quello sancito è un diritto insolito, particolarmente controverso ed eticamente e giuridicamente complesso, dai risvolti costituzionali in evoluzione e dalle ripercussioni politiche inaspettate. E’ ancora al centro di un dibattito estremamente vivace che coinvolge anche la giurisprudenza della Corte Suprema e di cui l’autore ripercorre i tratti salienti fino agli sviluppi più recenti.
