La obligacion de proteccion en el transporte maritimo y aereo

The duty of care of passengers is examined first as an accessory and autonomous obligation as regards the transfer obligation. Secondly the foundation of its essentiality in the context of the contract of transport is considered. Then the standard and the contents of the obligation are examined in the rules relating to maritime and air transports. In conclusion, the differences existing in the regulation of maritime and air transport do not look completely justified.

La obligacion de proteccion de las personas transportadas es examinada, en premier lugar, bajo el punto de vista de su accessoriedad y autonomia respecto de la obligacion de traslado. En segundo lugar, se investiga el fundamento de su esencialidad en el contexto del contrato de transporte. A continuacion, se procede a examinar los perfiles del alcance y del contenido de la obligacion de proteccion en la normativa que regula los transportes maritimos y aereos. Se concluye en el sentido de que las diferencias que subsisten entre la regulacion del transporte maritimo y aereo no parecen del todo justificadas.
