Book Review: Micaela Frulli, Immunità e crimni internazionali. L’esercizio della giurisdizione penale e civile nei confronti degli organi statali sospettati di gravi crimini internazionali

The author of the book under review denies the existence of a customary rule on the immunity of state organs and recognizes that they enjoy functional immunity only in specific situations. In oder to explain the practice in the field of international crimes which denies state organs immunity, she maintains that international crimes are categories of acts ultra vires. The book is very detailed and convincing in particular when it criticizes the more recent practice of "expansive" immunity. However, it seems more difficult to share the argument concerning the relationship between functional immunity and individual responsibility for international crimes, in particular because of the consequences this argument indirectly has with respect to State responsibility.

E’ noto che l’autore del volume che qui si recensisce nega l’esistenza di una norma consuetudinaria generale sull’immunità degli organi e riconosce solo specifiche ipotesi in cui certi organi godono di un’immunità funzionale in base al diritto internazionale. Per spiegare la prassi in materia di crimini internazionali pertanto afferma che i crimini internazionali sono categorie di atti ultra vires. Il volume appare molto dettagliato e convincente anche nelle critiche alla prassi “espansiva” più recente, tuttavia appare più difficile condividere la spiegazione offerta in materia di rapporto tra immunità funzionale e responsabilità penale per crimini internazionali, soprattutto per le conseguenze che indirettamente tale tesi ha in relazione alla responsabilità dello Stato.
