The essay aims to comment on a communication approved by the European Commission at the end of 2011, dedicated to the quality of the regulation of services of general interest. After a brief description of the contents of this document, the author focuses on some aspects. Particularly, he notes that the Communication announces a multitude of new features expanding the discretion of the member states in the regulation of these services. In this way the EU reverses its approach about the interference with the law of public services since the EU has been increasingly invasive in this matter from the beginning of the end of the eighties of the last century . Il saggio si propone di commentare una comunicazione approvata dalla Commissione europea alla fine del 2011 dedicata alla qualità della regolazione dei servizi di interesse generale. Dopo una breve descrizione del contenuto di questo atto, l'autore si sofferma sugli aspetti di maggiore interesse. In particolare rileva che la comunicazione annuncia una serie di novità che vanno nella direzione di ampliare la discrezionalità degli stati membri nella regolazione di tali servizi. Questo denuncia un'inversione di tendenza da parte dell'UE dal momento che a partire dalla fine degli anni ottanta dello scorso secolo si è sempre più ingerita in questa materia. Ciò delinea una nuova tecnica di integrazione che è fondata sulla valorizzazione (e sul governo) delle differenziazioni nazionali. Entro alcune condizioni che la comunicazione e altri atti definiscono, infatti, l'UE favorisce il maggior interventismo degli stati nazionali nella convinzione che questo rafforzi gli obiettivi di maggiore integrazione europea.
