In 2011 the ICC, acting under Art. 12(3) Statute, began exercising its jurisdiction over crimes committed by nationals and in a territory of a State which was not a Party to the Statute: Ivory Coast. Moreover, it issued an arrest warrant against the Libyan Head of State, Muammar Gheddafy, and the Libyan Prime Minister, Saif Al-Islam Gheddafi, both of whom enjoying jurisdictional immunity under international law; denied the motion seeking permanent staying of the proceedings against Lubanga Dyilo (in DRC); informed the UNSC and the ASP about the failure by Chad, Djibouti and Malawi to comply with its requests of arresting and surrendering Omar Al-Bashir; confirmed the charges against Abakaer Nourain and Jerbo Jamus (in Sudan); denied the application for provisional release of Bemba Gombo following the opening of the trial (in RCA); denied Kenyan Goverment applications challenging the admissibility of six cases; issued an arrest warrant against former Ivorian Head of State.
