Aesthetica iuris. L'estetica trascendentale di Fichte come presupposto di una filosofia del diritto

The importance of aesthetics in Fichte assumes a paradigmatic role as the very possibility of philosophy of law. In this direction remains the central problem of the action expressed in the co-existence, which, if not mediated by aesthetic representation and not measured by the law, is relegated to a condition instinctual nature of the matrix, then indifferent in its genesis and in its outcomes, which may be investigated only from a purely theoretical point of view object. The hypothesis of the instinctual nature of the action, however, is inconsistent with the joint demonstrations of human reason and freedom that characterizes it, then the emerging reality of a spiritual state that environmental human action. The aesthetic dimension, therefore, makes it possible philosophical thought on the right, as a reason internal to the relationship between the individual, a reason that may be appointed aesthetic and legal.

L'importanza dell'estetica assume in Fichte un ruolo paradigmatico, quale possibilità stessa della filosofia del diritto. In questa direzione resta centrale il problema dell'azione espressa nella coesistenza, che, se non mediata dalla rappresentazione estetica e non misurata dal diritto, rimane relegata in una condizione istintuale di matrice naturalistica, dunque indifferente nella sua genesi e nei suoi esiti, eventualmente indagabili solo da un punto di visto meramente teoretico oggettuale. L'ipotesi della natura istintuale dell'azione, tuttavia, non si concilia con le manifestazioni unitarie della ragione umana e della libertà che la caratterizza, emergendo quindi la realtà di uno stato spirituale che ambienta l'agire dell'uomo. La dimensione estetica, dunque, rende possibile il pensiero filosofico sul diritto, come ragione interna alla relazione tra i singoli, una ragione che può nominarsi estetico-giuridica.
