The author analyzes the telecommunication service liberalisation highlighting the techniques adopted by Italy as a consequence of the EC law. The research takes into account of laws, rulings and decisions from the authorities of regulation coming to sort the various types of access to the market for the undertakings. Lastly, the author draws some conclusions on the legal value of the liberalisation and on the legal notion of public service in Italy. In particular he holds that the notion of public service is shattered now; it does not suit to the entire service, but only to some specific segments. The notion is changeable and reflected in the development of the liberalisation policy which, by its nature, is dynamic and relative.

La ricerca mira a valutare la liberalizzazione dei servizi di telecomunicazione analizzando le varie tecniche adottate nell'ordinamento interno su impulso di quello comunitario. La ricerca ha preso in esame sia le norme di liberalizzazione, sia la giurisprudenza, specie quella comunitaria, i provvedimenti dell'autorità di regolazione di settore, nonché l'autorità gante per la concorrenza e il mercato, classificando varie tipologie di accesso al mercato realizzate. Alla fine l'autore elabora alcune conclusioni sul valore giuridico delle liberalizzazioni e sul riflesso che esse comportano sulla nozione di servizio pubblico. In particolare si considera che la nozione di servizio pubblico viene frammentata e si commisura non più sul servizio nel suo complesso ma solo su specifici segmenti. La definizione però è mutevole e riflette lo stesso processo di liberalizzazione che, per sua natura, è dinamico e relativo.

Abstract
