Le opinioni della Commissione di Venezia sul sistema elettorale

This article examines the Opinions on the electoral system issued by the European Commission for Democracy through Law (Venice Commission) of the Council of Europe. After contextualizing the elements of the electoral system within the European constitutional heritage, the analysis will proceed on two levels. First, it will focus on procedural aspects, observing the remarks contained in the Opinions on the sources of law used and the breadth of consensus in the legislative process leading to the definition of the central aspects of electoral legislation. Subsequently, it will focus on the substantive elements of electoral rules that the Opinions have identified as problematic, ranging from technical aspects to systemic choices that are potentially dangerous for the democratic nature of representative constitutional systems and observing how these assessments change depending on their legal, political and cultural context.
