The essay analyzes the issue of standing to bring an action in administrative proceedings and, in particular, the question whether, for the purposes of standing, it is sufficient for the claimant to allege that a legitimate interest (in Italian interesse legittimo) has been infringed, or whether the claimant must demonstrate actual entitlement to such a legitimate interest. The essay first highlights that the statutory provisions governing administrative powers rarely expressly qualify an interest as a legitimate interest, which explains why case law states that a legitimate interest emerges and is identified in the course of judicial proceedings, and that it is therefore not possible to clearly separate the substantive legal position from the standing to bring an action. The essay then focuses on the different conceptions of legitimate interest, whose substantive nature is now beyond doubt. It also reconstructs the subject matter (in Italian oggetto, in German Streitgegenstand) of administrative court proceedings, which is variously identified as the contested administrative act, the legal relationship, or the legitimate interest. The essay leans towards the latter reconstruction, which appears more consistent with the Code of Administrative Procedure, as it brings administrative court proceedings closer to civil court proceedings and, ultimately, supports the thesis that, for the purposes of standing to bring an action, it is sufficient for the claimant to assert the existence of a legitimate interest
Il saggio analizza il tema della legittimazione a ricorrere nel processo amministrativo e, in particolare, il problema se, ai fini della legittimazione, è sufficiente che il ricorrente affermi di essere stato leso in un proprio interesse legittimo oppure debba dimostrare di essere effettivamente titolare di tale interesse legittimo. Il saggio sottolinea anzitutto il fatto che le norme che disciplinano i poteri amministrativi di rado qualificano espressamente un interesse come interesse legittimo e ciò spiega perché la giurisprudenza afferma che l’interesse legittimo emerge e si individua nel processo e che pertanto non è possibile separare nettamente la situazione giuridica sostanziale dalla legittimazione a ricorrere. Il saggio si sofferma poi sulle diverse concezioni dell’interesse legittimo del quale è ormai indubitabile la natura sostanziale. Ricostruisce altresì l’oggetto del processo (in Germania Streitgegenstand) che è variamente individuato nell’atto amministrativo impugnato, nel rapporto giuridico o nell’interesse legittimo. Il saggio propende per quest’ultima ricostruzione,più conforme al Codice del processo amministrativo, che allinea di più il processo amministrativo al processo civile e che in definitiva avvalora la tesi secondo la quale ai fini della legittimazione a ricorrere è sufficiente che il ricorrente affermi di essere titolare di un interesse legittimo.
