Oltre i Trattati? La progressiva integrazione della difesa europea

Although the EU Treaties do not confer upon the European Union a general competence in the field of defence and continue to reserve national security to the Member States, recent developments reveal the gradual emergence of a European dimension of defence through regulatory, financial, industrial, infrastructural, and operational instruments. This phenomenon recalls earlier phases of the European integration process, in which the material constitution preceded the formal constitution, paving the way for subsequent treaty reforms or judicial reinterpretations. Sebbene i trattati non attribuiscano all'Unione europea una competenza generale in materia di difesa e mantengano la sicurezza nazionale nella sfera degli Stati membri, l'evoluzione degli ultimi anni mostra la progressiva formazione di una dimensione europea della difesa attraverso strumenti normativi, finanziari, industriali, infrastrutturali e operativi. Questo fenomeno richiama altre fasi del processo di integrazione europea, nelle quali la costituzione materiale ha preceduto la costituzione formale, preparando successivi adattamenti dei trattati o reinterpretazioni giurisprudenziali.
