The Constitutional Court, in judgment no. 68 of 22 May 2025, declared the unconstitutionality of Article 8 of Law no. 40/2004 insofar as it does not allow the recognition, from birth, of the status of child in relation to the intended mother in female same-sex couples who have resorted abroad, in compliance with the lex loci, to medically assisted reproduction techniques. The Court grounds its decision on the relationship between the legal value of procreative consent – considered a valid basis for establishing parental responsibility – and the centrality of the child’s best interests, which it identifies as a constitutional parameter drawn from Articles 2, 3 and 30 of the Constitution, as well as from international and European sources. The judgment represents a significant step forward in recognising dual motherhood, enhancing parental responsibility deriving from informed consent to assisted reproduction and affirming that the child’s best interests require the automatic recognition, from birth, of the status of child of both mothers. The existing remedy of adoption in particular cases is deemed inadequate, as it does not provide sufficient and timely protection of the child’s status of filiation due to its contingent nature, procedural complexity, and dependence on the adult’s initiative. These features negatively affect the child’s personal identity, the stability of family relationships, and the certainty of legal relations, resulting in aconstitutional shortcoming that can no longer be deferred.
La Corte costituzionale, con sentenza n. 68 del 22 maggio 2025, ha dichiarato l’illegittimità dell’art. 8 l. n. 40/2004 nella parte in cui non consente il riconoscimento, sin dalla nascita, dello status di figlio nei confronti della madre intenzionale nelle coppie omogenitoriali femminili che abbiano fatto ricorso all’estero, nel rispetto della lex loci, a tecniche di procreazione medicalmente assistita. Il giudice delle leggi fonda la propria decisione sull’articolazione tra il valore giuridico del consenso procreativo, quale titolo idoneo a generare responsabilità genitoriale, e la centralità del miglior interesse del minore, quale parametro costituzionale ricavabile dagli artt. 2, 3 e 30 cost., nonché dalle fonti internazionali ed europee. La sentenza rappresenta un passaggio rilevante nel riconoscimento della doppia maternità, valorizzando la responsabilità genitoriale derivante dal consenso informato alla PMA e affermando che l’interesse del minore impone un riconoscimento automatico dello status di figlio di entrambe le madri sin dalla nascita. Si ritiene superato l’attuale rimedio dell’adozione in casi particolari, in quanto non offre una tutela adeguata e tempestiva allo status filiationis del minore, per la sua natura eventuale, procedimentalizzata e subordinata all’iniziativa dell’adulto, che incide negativamente sull’identità personale del nato, sulla stabilità delle relazioni familiari e sulla certezza dei rapporti giuridici, integrando un vulnus costituzionale non piú differibile.
