This paper aims to describe the events surrounding the first case in Italy involving the application of the settlement procedure pursuant to Article 14-quater of Act No. 287 of October 10, 1990, in an administrative proceeding conducted by the Italian Competition Authority (ICA). In particular, the paper seeks to highlight the elements of administrative discretion inherent in the settlement framework and the assessments of appropriatenes s that the Authority conducts for the purpose of initiating the procedure.
