La portata giuridica del contenuto eventuale dello statuto regionale nella prassi degli organi di garanzia statutaria

In the Constitutional Court's jurisprudence, the general principles and programmatic norms held in the beginning of the regional charters were considered as an expression of mere political and cultural convictions, with no juridical effect. The italian literature expressed severe criticism towards this opinoin, holding that the Court did not have the power to decide that a norm is not juridical, but only the power to declare it unconstitutional. The regional bodies for rhe statutory guarantee, in some interesting cases, seem to confirm the opinion expressed by the literature. Indeed, they have held these principle as juridical and applied them to the case.
