Against the backdrop of the growing strategic importance of critical raw materials—and their farreaching economic, industrial, and security implications—this Article examines the principal legal issues governing the supply of critical resources, with particular attention to both the existing regulatory framework. It argues that significant divergences emerge between the regulatory paradigms adopted by the United States and the European Union, and it critically assesses the strategies each has developed to confront the geopolitical and security challenges that increasingly characterize this field.
