Le osservazioni orali del presidente Mattarella nel caso del decreto sicurezza. Brevi notazioni a partire dal d.l. n. 23/2026

This contribution aims to focus on the procedural issues involving the President of the Republic, Sergio Mattarella, in the context of the enactment of Decree-Law No. 23/2026 (Security Decree) and its subsequent conversion into law. In particular, the President, having not immediately proceeded with the enactment of the decree because he had identified issues of “constitutional appropriateness” in the text approved by the Council of Ministers, exercised moral suasion in an oral form, without issuing any written statements from the Quirinale, in order to “bring the legislative text back into line with the Constitution,” as it was potentially harmful to numerous constitutionally recognized and guaranteed principles.
