Solidarietà e rapporti civili

The essay focuses on the normative signi!cance and the possible forms that solidarity may assume within the current legal system, and then examines its sphere of operation, both direct and indirect, as well as the corresponding degree of mandatory force. In this perspective, also through the use of certain indicative concepts and the analysis of selected cases and practical issues concerning obligations, contractual autonomy and liability, the study explores the role of constitutional personalism and solidarism, and the necessary relationship, aimed at preventing abuses (of rights and of interpretation), between fundamental principles and general clauses, and, in particular, between solidarity and good faith.

Il saggio si sofferma sulla valenza normativa e sulle possibili declinazioni che la solidarietà può assumere nel sistema ordinamentale vigente, per poi esaminarne l’àmbito di operatività, diretto e indiretto, e il relativo grado di inderogabilità. In questa direzione, anche grazie al ricorso ad alcune figure sintomatiche e all’analisi di taluni casi e questioni pratiche, in tema di obbligazioni, autonomia negoziale e responsabilità, s’indaga sul ruolo del personalismo e del solidarismo costituzionali e sulla necessaria relazione, funzionale ad evitare abusi (del diritto e interpretativi), tra princípi fondamentali e clausole generali, nonché, in particolare, tra solidarietà e buona fede.
