This paper aims to investigate, from a constitutional perspective, the critical issue of detention centres for repatriation in Italy, particularly with regard to the guarantee of the right to a fair trial and the right to be heard. Starting with an initial assessment of the legal classification of the right to a fair trial in relation to the principle of habeas corpus, it then proceeds to analyse Constitutional Court ruling no. 96/2025, which has become a milestone in the discussion of this issue. In conclusion, the paper examines points of contact with a slightly earlier ruling, no. 76/2025.
