The essay analyzes the concept of «safe country of origin» and its evolution in national legislation in order to assess both its consistency with Article 10 of the Constitution and its paradoxical instrumentalization in relation to security concerns aimed at a «restrictive» policy of migration management. From this perspective, the Alace and Canpelli case is seen as a turning point and, at the same time, the culmination of the clash between political power and judicial power, the latter understood as a (constitutional) limit to power.
