On 1 August 2025, the Court of Justice delivered its much-awaited judgment in the case Alace and Canpelli (joined cases C-758/24 and C-759/24), which follows closely and, to some extent, completes the picture sketched out in the CV ruling (case C‑406/22) concerning judicial control over national designations of safe countries of origin. This contribution examines the Court’s reliance on Article 47 of the EU Charter of Fundamental Rights in the judgment and assesses its impact on national procedural autonomy. It also reflects on the future implications of the judgment in light of the imminent changes to the normative framework governing common procedures for international protection.

Abstract
On 1 August 2025, the Court of Justice delivered its much-awaited judgment in the case Alace and Canpelli (joined cases C-758/24 and C-759/24), which follows closely and, to some extent, completes the picture sketched out in the CV ruling (case C‑406/22) concerning judicial control over national designations of safe countries of origin. This contribution examines the Court’s reliance on Article 47 of the EU Charter of Fundamental Rights in the judgment and assesses its impact on national procedural autonomy. It also reflects on the future implications of the judgment in light of the imminent changes to the normative framework governing common procedures for international protection.I documenti in IRIS sono protetti da copyright e tutti i diritti sono riservati, salvo diversa indicazione.
