Giurisdizioni (solo) comunicanti. Il seguito del pensiero di Andrea Orsi Battaglini nella giurisprudenza costituzionale

This essay aims to reflect on the reception of Andrea Orsi Battaglini’s original and challenging theses, contained in the 2005 book Alla ricerca dello Stato di diritto. Per una giustizia “non amministrativa” (Sonntagsgedanken), in Italian constitutional case law over the past twenty years. To this end, setting aside certain connections that can be identified but are mediated by legislative intervention, the essay highlights direct connections observed regarding the position of the administrative judge, the duality of jurisdictions and procedural guarantees in administrative proceedings.
