The article analyses Judgment No. 204 of 2025 of the Italian Constitutional Court on medically assisted suicide, which declared most of the Tuscan regional law unconstitutional, reaffirming the State’s legislative competence and the need for rigorous and non-accelerated evaluations in response to requests for assisted suicide on end of life decisions. The paper reconstructs the evolution of constitutional case law since Judgment No. 242 of 2019, highlighting its ambiguities and internal tensions, particularly between the protection of life, individual self-determination, and the role of the National Health Service. It identifies three main contradictions: between the duty to protect life and public involvement in assisted dying; between the denial of binding obligations and the recognition of enforceable claims; and between the proclaimed centrality of the legislature and the actual narrowing of its regulatory discretion imposed by the Court itself. The article concludes by criticising the prospect of legislation on assisted suicide, which is seen as likely to produce expansive effects and to profoundly affect medical ethics and the healthcare system, instead advocating for the strengthening of palliative care and comprehensive support for vulnerable patients.
Il contributo analizza la sentenza n. 204 del 2025 della Corte costituzionale sul suicidio medicalmente assistito, che ha dichiarato in larga parte illegittima la legge della Regione Toscana, riaffermando la competenza statale e la necessità di valutazioni rigorose e non accelerate a fronte di richieste di suicidio asistito. L’articolo ricostruisce l’evoluzione della giurisprudenza costituzionale a partire dalla sentenza n. 242 del 2019, mettendone in luce ambiguità e tensioni interne, in particolare tra tutela della vita, autodeterminazione e ruolo del Servizio sanitario nazionale. Si evidenziano tre principali contraddizioni: tra dovere di tutela della vita e coinvolgimento pubblico nell’aiuto a morire; tra negazione di obblighi normativi e riconoscimento di pretese esigibili; tra affermazione della centralità del legislatore e riduzione dei suoi margini di intervento ad opera della stessa Corte. Il lavoro conclude criticando l’ipotesi di una legge sul suicidio assistito, ritenuta suscettibile di produrre effetti espansivi e di incidere profondamente sull’etica medica e sul sistema sanitario, proponendo invece il rafforzamento delle cure palliative e della presa in carico dei pazienti fragili.
