La diligenza e la responsabilità dell'avvocato nei rapporti con il proprio assistito

This contribution aims to study the relationship between solicitors and their clients, in light of the fiduciary nature of the defence mandate and the complexity of professional legal responsibility, in relation to the provisions of Articles 1176, paragraph 2, and 2236 of the Italian Civil Code. Special attention is paid to the nature of the obligation - of means or of result - that the defence lawyer has towards his or her client, as well as to the principles of fairness and good faith, which, in turn, take on an autonomous and “parallel” role with respect to professional performance.

Il contributo intende studiare il rapporto tra avvocato e assistito, alla luce della natura fiduciaria del mandato difensivo e la complessità della responsabilità professionale forense, in relazione ai canoni sanciti dagli artt. 1176, 2° comma e 2236 c.c. Speciale attenzione è dedicata alla natura dell'obbligazione - di mezzi ovvero di risultato - cui è tenuto il difensore nei confronti del proprio cliente, oltre che sui principi di correttezza e buona fede che, a loro volta, assumono un ruolo autonomo e “parallelo” rispetto alla prestazione professionale.
