Il protocollo Italia-Albania per il rafforzamento della collaborazione tra i due paesi in materia migratoria e la sua legge di ratifica ed esecuzione

The essay examines some issues of Italian constitutional law in relation to the Protocol between Italy and Albania of Cooperation on Migration Management and its Ratification Law. The Author aims to demonstrate that this Protocol is problematic from a constitutional standpoint, both for the contents and deformalised ways in which that cooperation takes place. Indeed, the difficult justiciability of constitutional norms regarding foreign power, in the presence of evasive practices, it reflects on compliance with constitutional, international and supranational norms for the protection of fundamental rights.
