Environmental compliance promotes the appli-cation of good practices in public and private companies, complying with the sustainability criteria of the United Na-tions Agenda 2030. Thus, the compliance program acts in the prevention and mitigation of risks, in accordance with the Anti-Corruption Law No. 12,846/2013, regulated by Decree No. 8,420/2015. Therefore, there is a primacy of sustainable bidding for national development, as companies must adapt to the best distribution of inputs, equipment, waste management, and socio-economic development. Thus, ESG (which stands for Environmental, Social and Governance) factors are measu-res of corporate social responsibility and have a positive impact on the probity of domestic and foreign public administration. Bill No. 5442/2019 is presented for environmental complian-ce in granting incentives to the activities of public and private companies, to the extent that they operate in economic activi-ty potentially harmful to natural assets. The method used was analytical, supported by specialized doctrine and legislation of the national and international legal system.
